Please read these Terms of Service (collectively with Followers QR’s Privacy Policy, the "Terms of Service") fully and carefully before using mobile applications, and services, features or content offered by Followers QR ("we", "us" or "our") (together with the "Services").
By accessing and using the Followers QR Services, you accept and agree to be bound by the terms and provision of the terms.
Please read these Terms carefully. These Terms govern your access to and use of the Services. You must accept these Terms prior to using the Site and/or the Application. 1.NOTICE TO PARENTS AND GUARDIANS: By granting your child permission to download and access an app from us, you agree to the terms and conditions of this Followers QR on behalf of your child. You are responsible for exercising supervision over your children's online activities. If you do not agree to this Followers QR, do not let your child use our apps or associated features. If you are the parent or guardian of a child under 8 and believe that he or she is using the Apps, please contact us.
2. You use the Followers QR services only for personal purposes (you may not use them for commercial purposes). You may not use the Followers QR services for any illegal or unauthorized purpose. You agree to comply with all laws, rules and regulations (for example, federal, state, local and provincial) applicable to your use of the Service and your Content (defined below), including but not limited to, copyright laws. You are solely responsible for your conduct and any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, musical works, works of authorship, applications, links and other content or materials (collectively, “Content”) that you submit, post or display on or via the Service.
3. You must not interfere or disrupt the Service or servers or networks connected to the Service, including by transmitting any worms, viruses, spyware, malware or any other code of a destructive or disruptive nature, or access Followers QR's private API by any means other than in compliance with rules we set on API access.
4. You must not spam or submit any unwanted email or comments to any users of the Followers QR services, or use web URLs in your username without prior written consent from Followers QR.
5. You are not allowed to resell or charge others for use of or access to the Followers QR services, or duplicate, reproduce, transfer, give access to, copy or distribute any part of the Followers QR services in any medium without Followers QR's prior written authorization
6. Violation of these Terms of Use may, in Followers QR’s sole discretion, result in a ban of Followers QR usage. You understand and agree that Followers QR cannot and will not be responsible for the Content stylize on the Service and you use the Service at your own risk. If you violate the letter or spirit of these Terms of Use, or otherwise create risk or possible legal exposure for Followers QR, we can stop providing all or part of the Service to you.
Some of the Followers QR Services are supported by advertising revenue and may display advertisements and promotions. You agree that Followers QR may place advertising and promotions on, about, or in conjunction with your Content. The manner, mode, and extent of such advertising and promotions are subject to change without notice to you. You acknowledge that we may not always identify paid services, sponsored content, or commercial communications as such.
The Followers QR Services may include virtual items or services that can be licensed for a fee, typically via an in-app purchase ("Purchased Content"). You may only license Purchased Content if you are over 18 years old, and only on a limited, personal, non-transferable, non-sublicenseable and revocable basis for non-commercial use only. If you deactivate your account, you will no longer have access to previously Purchased Content even if you later re-activate your account or create a new account. Followers QR reserves the right to manage, regulate, control, modify, or eliminate Purchase Content at any time. Upon the Purchased Content being made available to you, Followers QR's obligations to provide Purchase Content are deemed fulfilled.
The Terms, Privacy Policy, and Additional Terms shall be governed by the laws of the State of California without giving effect to any conflicts of laws principles. The United Nations Conventions for International Sale of Goods does not apply to this agreement.
Followers QR Service is provided “AS IS” AND “AS AVAILABLE”, without express or implied warranty or condition of any kind. You use the Followers QR Service at your own risk. To the fullest extent permitted by applicable law, Followers QR and all owners of the content make no representations and disclaim any warranties or conditions of satisfactory quality, merchantability, fitness for a particular purpose, or non-infringement.
Limitations of Liability
In no event shall Followers QR be liable for any loss or damages (including without limitation of any direct, indirect, punitive, special, incidental or consequential loss or damage):
- Access to the Service or inability to access to the Service;
- Any third party's conduct, content, information or data;
- Personal injury or property damage, of any nature whatsoever, resulting from your access to and/or use of (or your inability to access and use) the Followers QR services, including, without limitation, making private content public or any damage caused to your computer or software or information stored thereon;
- Any unauthorized access to or use of Followers QR Services and/or any and all personal, private, and/ or other information stored therein.
