"App" as used here in refers to all products and services owned and operated by Six Pack Team.
Please read these Terms carefully. These Terms govern your access to and use of the Services. You must accept these Terms prior to using the Site and/or the Application. By clicking on the button indicating your assent you signify your assent to these Terms.
By using Six Pack (the "App"), you are agreeing to be bound by these terms of use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using the App. The materials contained in this App are protected by applicable copyright and trademark law.
Six Pack reserves the right to alter these Terms at any time in its sole discretion. When we make material changes to the Terms, we’ll provide you with prominent notice in appropriate way,please make sure you have read the notice in advance carefully. Your continued use of the Six Pack services after such notification of changes to the Terms will constitute your agreement and acceptance to such changes. You may stop using the Service under the new version of these Terms if you object to the changes.
Use of the Service is subject to the terms of Six Pack’s “Privacy Policy” which is hereby incorporated into and made part of this Agreement. Please carefully review our Privacy Policy. Any of your information which is collected by the Service is done so by Six Pack, in accordance with the terms set forth in Six Pack’s Privacy Policy. By using the Service, you acknowledge that you have read, and you agree to be bound by, the terms of our Privacy Policy. We reserve the right, and you authorize us, to use information regarding your use of the Service, account registration, and any other personal information provided by you in accordance with our Privacy Policy. You further acknowledge and agree that any disputes related to the Privacy Policy, including any breaches in security or privacy, will be subject to the limitations on liability and dispute resolution provisions contained in this Agreement.
1.You may only use the Service if you are thirteen years old or older, and if you assume the obligations set forth in this Agreement, and assume full responsibility for your use of the Service. Any person who provided their personal information to Six Pack represents that they are thirteen years of age or older. If you are 8 or older, but under the age of 18, you must review this Agreement with your parent or guardian to make sure that you and your parent or guardian understand and agree to it.
2. You use the Six Pack services only for personal purposes (you may not use them for commercial purposes). You may not use the Six Pack services for any illegal or unauthorized purpose. You agree to comply with all laws, rules and regulations (for example, federal, state, local and provincial) applicable to your use of the Service and your Content (defined below), including but not limited to, copyright laws. You are solely responsible for your conduct and any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, musical works, works of authorship, applications, links and other content or materials (collectively, “Content”) that you submit, post or display on or via the Service.
3. You must not interfere or disrupt the Service or servers or networks connected to the Service, including by transmitting any worms, viruses, spyware, malware or any other code of a destructive or disruptive nature, or access Six Pack's private API by any means other than in compliance with rules we set on API access.
4. You must not spam or submit any unwanted email or comments to any users of the Six Pack services, or use web URLs in your username without prior written consent from Six Pack.
5. You are not allowed to resell or charge others for use of or access to the Six Pack services, or duplicate, reproduce, transfer, give access to, copy or distribute any part of the Six Pack services in any medium without Six Pack's prior written authorization
6. Violation of these Terms of Use may, in Six Pack’s sole discretion, result in a ban of Six Pack usage. You understand and agree that Six Pack cannot and will not be responsible for the Content stylize on the Service and you use the Service at your own risk. If you violate the letter or spirit of these Terms of Use, or otherwise create risk or possible legal exposure for Six Pack, we can stop providing all or part of the Service to you.
Some of the Six Pack Services are supported by advertising revenue and may display advertisements and promotions. You agree that Six Pack may place advertising and promotions on, about, or in conjunction with your Content. The manner, mode, and extent of such advertising and promotions are subject to change without notice to you. You acknowledge that we may not always identify paid services, sponsored content, or commercial communications as such.
The Six Pack Services may include virtual items or services that can be licensed for a fee, typically via an in-app purchase ("Purchased Content"). You may only license Purchased Content if you are over 18 years old, and only on a limited, personal, non-transferable, non-sublicenseable and revocable basis for non-commercial use only. If you deactivate your account, you will no longer have access to previously Purchased Content even if you later re-activate your account or create a new account. Six Pack reserves the right to manage, regulate, control, modify, or eliminate Purchase Content at any time. Upon the Purchased Content being made available to you, Six Pack's obligations to provide Purchase Content are deemed fulfilled.
The Terms, Privacy Policy, and Additional Terms shall be governed by the laws of the State of California without giving effect to any conflicts of laws principles. The United Nations Conventions for International Sale of Goods does not apply to this agreement.
Six Pack Service is provided “AS IS” AND “AS AVAILABLE”, without express or implied warranty or condition of any kind. You use the Six Pack Service at your own risk. To the fullest extent permitted by applicable law, Six Pack and all owners of the content make no representations and disclaim any warranties or conditions of satisfactory quality, merchantability, fitness for a particular purpose, or non-infringement.
Limitations of Liability
In no event shall Six Pack be liable for any loss or damages (including without limitation of any direct, indirect, punitive, special, incidental or consequential loss or damage):
- Access to the Service or inability to access to the Service;
- Any third party's conduct, content, information or data;
- Personal injury or property damage, of any nature whatsoever, resulting from your access to and/or use of (or your inability to access and use) the Six Pack services, including, without limitation, making private content public or any damage caused to your computer or software or information stored thereon;
- Any unauthorized access to or use of Six Pack Services and/or any and all personal, private, and/ or other information stored therein.
